Acceptable Use Policy

Purpose
This Acceptable Use Policy describes the conduct expected of everyone who uses the Perch Service. It is incorporated into and forms part of our Terms of Service. Violating this AUP may result in content removal, suspension, or termination.
You must not use Perch to
- Break the law. Engage in unlawful activity or violate the intellectual-property, privacy, or publicity rights of others.
- Harm people. Upload, publish, or transmit content that is threatening, abusive, harassing, defamatory, discriminatory, or incites violence or hate against individuals or groups based on characteristics protected by law.
- Violate labor laws. Create schedules or use features in a way that violates minimum-wage, overtime, rest-break, child-labor, fair-workweek, predictive scheduling, or collective-bargaining laws in your jurisdiction. You are solely responsible for legal compliance of the schedules you publish.
- Misuse staff data. Upload or collect personal data of staff members without a lawful basis or without providing any required notices. Do not use Perch to track, surveil, or monitor staff in ways that violate privacy laws.
- Upload malicious content. Distribute viruses, malware, ransomware, phishing content, or any code designed to damage or disrupt systems or users.
- Interfere with the Service.Attempt to probe, scan, or test the vulnerability of the Service; defeat rate limits or security controls; access accounts, data, or systems you’re not authorized to access; scrape data through automated means beyond documented APIs.
- Reverse-engineer. Decompile, reverse-engineer, or disassemble any portion of the Service except as explicitly permitted by applicable law.
- Misrepresent yourself. Impersonate another person or entity, misstate your affiliation with any Organization, or fraudulently create accounts.
- Abuse communications. Use Perch to send unsolicited commercial messages (spam), phishing attempts, or bulk messages that recipients have not consented to receive.
- Abuse billing. Charge back payments you authorized, use stolen payment methods, abuse free-trial or promotional terms through repeated signups, or circumvent our per-venue pricing model.
- Resell without permission. Resell, sublicense, or white-label the Service to third parties without a written agreement with Perch.
- Circumvent limits.Exceed the plan limits you’ve purchased through technical workarounds, shared accounts, or multiple-account gaming.
- Train third-party AI. Export data from Perch specifically to train machine-learning or artificial-intelligence models for third parties without authorization from the data subjects.
Special care for staff data
Perch holds personal data about people who may not themselves have logged in: your staff members. When you use Perch, you are responsible for:
- Having a lawful basis to process their data (typically an employment contract)
- Providing the required privacy notices to them
- Responding to their data-subject rights requests (we’ll help as your processor)
- Not collecting or uploading sensitive/special-category data (health, religion, biometrics, union membership) unless you have additional lawful grounds and safeguards in place
- Keeping their data accurate and removing it when it’s no longer needed
Reporting abuse
If you believe someone is using Perch in violation of this AUP, report it to abuse@onperch.co. Include enough detail for us to investigate (Organization name, affected user or venue, description of the violation, any evidence).
Security vulnerabilities: please email security@onperch.co rather than exploiting them. We will acknowledge responsible disclosures in good faith and work with you to remediate.
Enforcement
We investigate AUP reports at our discretion. Depending on severity, we may:
- Warn the violating user or Organization
- Remove or disable specific content or features
- Temporarily suspend access
- Terminate the Account or Organization
- Cooperate with law-enforcement or legal authorities where legally required
For egregious violations (child exploitation, credible threats of violence, active security attacks), we may act immediately without prior notice.
Changes to this Policy
We may update this AUP to address new behaviors or legal requirements. Material updates will be announced via email or in-app notice. Continued use after updates take effect constitutes acceptance.
